Melyro Terms of Use
These Terms of Use ("Terms") apply to the Melyro app for iPhone, iPad and Apple TV, including its CarPlay, AirPlay, Picture in Picture, external display, Handoff, Google Cast (iPhone and iPad) and Top Shelf (Apple TV) features (together, the "App").
1. Who we are
The App is provided by the developer of Melyro, an individual developer based in Türkiye, shown as the seller on the App Store ("we", "us", "our"). You can reach us at support@melyro.app.
2. How these Terms fit with Apple's licence
- Your licence to use the App is Apple's Licensed Application End User License Agreement (the "Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms do not replace it.
- These Terms are additional terms that supplement the Standard EULA. They cover what the Standard EULA does not, such as the media sources you add, purchases, acceptable use and disputes.
- If these Terms conflict with the Standard EULA on a licence matter, the Standard EULA prevails. Licence matters are the scope of your right to use the App, the restrictions on that use, and the warranty and liability terms set out in the Standard EULA.
- These Terms are published at https://melyro.app/terms.html. By using the App after being shown these Terms, you agree to them. If you do not agree, do not use the App.
3. What the App is
- Melyro is a media player. It ships with no channels, films, series, playlists or other content, and we do not provide, sell, host, index, link to or recommend any content or content provider.
- The App plays only what you add yourself, such as:
- an M3U playlist (a file or a web address);
- a login for an Xtream-compatible service (server address, username and password); or
- your own Jellyfin or Emby server.
- Every source you add is run by you or by a third party (a "provider"). The App connects to the provider directly from your device. We do not operate, control, check or monitor any provider. We have no user accounts and receive no information about the sources you add or what you watch, so we cannot identify users or provide viewing records. The only records we can access are the anonymous purchase records described in the Privacy Policy.
- Content you reach through the App stays on the provider's servers. We cannot remove, block or change it. Requests to take content down must go to the provider that hosts it.
- You need a supported Apple device and version of iOS, iPadOS or tvOS, an internet or local network connection, and a working source. Whether a stream plays depends on its format, the provider and your network.
4. Your sources and your responsibility
- You alone are responsible for making sure you have the legal right to access, stream and watch every source and every piece of content you use with the App. If you are unsure, do not add the source.
- You must not use the App to access, stream, share or distribute content without the permission of the rights holder, or in any other way that breaks the law of the country you are in.
- Your relationship with a provider, including any payment, subscription, account or content dispute, is between you and that provider. We are not a party to it and are not responsible for the provider's content, legality, availability, quality or security.
- You are responsible for the logins, passwords, playlist addresses and servers you enter. Some providers use unencrypted (
http://) connections, and some stream addresses contain your username and password. When you cast or play to another device, that device receives either the provider's stream address (which for some providers contains your username and password) or a temporary address on your local network that the App serves from your device, together with the title and category. For Google Cast, the stream address is also loaded by Google's media receiver. Casting is your choice, and we are not responsible for how the receiving device or Google handles this information. Only add and cast sources you trust, and only to devices you control. - Sources can contain content that is not rated or not suitable for children. The App is rated for adults on the App Store. Parental controls in the App, such as the PIN, are a convenience. They do not guarantee that a child cannot reach a source.
5. Who may use the App
You must be an adult under the law where you live, or use the App and make purchases only with your parent's or guardian's permission. Parents and guardians are responsible for supervising children's use and for Apple's Screen Time and purchase settings. The App is not directed at children under 13. The Privacy Policy's section on children explains more.
6. Driving and CarPlay
CarPlay video is available only when Apple's system and your vehicle report that the car is parked. We do not control that check. You are solely responsible for using the App safely in a vehicle. Never watch video or operate the App in a way that distracts you while driving, and obey traffic laws and the instructions of your vehicle maker. Section 14.2 still applies.
7. Melyro Pro: purchases and subscriptions
- Apple handles all payments. All purchases are made through Apple's App Store. Apple is the merchant of record and processes your payment under its own terms. We do not see or store your payment details.
- Melyro Pro. Some features of the App, such as iCloud sync, require Melyro Pro. Melyro Pro is offered as:
- Melyro Pro Monthly: an auto-renewing monthly subscription;
- Melyro Pro Yearly: an auto-renewing yearly subscription; or
- Melyro Pro Lifetime: a one-time purchase that does not renew.
- No content included. A purchase unlocks features of the App only. It gives you no access to any channel, playlist, provider or content.
- Prices. Prices are shown in the App and on the App Store before you buy, in your local currency, and may include taxes. Prices can differ by country.
- Free trial. The yearly subscription may include a 7-day free trial. Eligibility for the free trial is decided by Apple (for example, one trial per Apple Account). If you do not cancel at least 24 hours before the trial ends, the yearly subscription starts and your Apple Account is charged the yearly price.
- Automatic renewal. Subscriptions renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the end of the current period. Apple charges your Apple Account within the 24 hours before the period ends.
- Cancelling. You can cancel or change a subscription in your Apple Account subscription settings on any device: on iPhone or iPad in Settings, under your name and then Subscriptions; on Apple TV in Settings, Users and Accounts, your account, then Subscriptions; or in the App Store. Apple explains the steps at https://support.apple.com/118428. If you cancel, you keep access until the end of the period you have paid for. Deleting the App does not cancel a subscription.
- Price changes. If the price of a subscription changes, Apple will tell you in advance and, where Apple's rules or the law require, ask for your consent before the new price applies.
- Refunds. Apple handles refunds under its own policies. You can request one at https://reportaproblem.apple.com. We cannot issue refunds ourselves. This does not affect any rights you have under the law of your country, including any right of withdrawal, which you exercise through Apple.
- Restoring purchases. You can restore a purchase in the App while signed in with the Apple Account you used to buy it. One purchase covers the App on iPhone, iPad and Apple TV under the same Apple Account.
- Lifetime. Lifetime is a one-time purchase with no renewal. It gives you Melyro Pro for as long as the App is available for your device, and it is linked to your Apple Account. It does not promise that the App will be offered or updated forever (see Section 12).
- Free Pro access. We may give Melyro Pro free of charge to some users, for example to people who first downloaded the App before Melyro Pro went on sale, as shown by Apple's purchase record. We decide the scope of such access.
- Family Sharing and other Apple features. Whether a purchase can be shared, moved or refunded depends on Apple's settings and rules.
8. Acceptable use
When using the App, you agree not to:
- use it to infringe copyright or other rights, or to break any law;
- use it to get around paywalls, geo-blocks, access controls or technical protection on any provider's service;
- interfere with, overload or attack any server, network or device;
- get around the App's purchase checks, or share, sell or distribute modified copies of the App; or
- copy, modify, decompile or reverse-engineer the App, except where the law, or an open-source licence for a component, allows it.
9. Copyright and other notices
- We do not host content, so we cannot take it down. If you believe content you found through a provider infringes your rights, contact the provider that hosts it.
- Send notices about the App itself, such as a claim that the App's code, name, artwork, App Store listing or website infringes your rights, to support@melyro.app. Please include:
- who you are and how to reach you;
- the work or right you say is infringed;
- where in the App or its listing the problem appears; and
- a statement that the information is accurate and that you are the rights holder or authorised to act for them.
- We review notices in good faith and may change or remove material we control. We may refuse a notice that does not identify the problem.
10. No affiliation and trademarks
- Melyro is an independent app. It is not affiliated with, endorsed by, sponsored by or approved by any IPTV service, content provider, broadcaster or rights holder, or by Jellyfin, Emby, Xtream Codes, Google, RevenueCat or VideoLAN.
- Jellyfin, Emby, Xtream Codes, Google Cast, Chromecast, VLC and other product names are trademarks of their owners. We use them only to describe what the App works with.
- Apple, iPhone, iPad, Apple TV, CarPlay, AirPlay, iCloud, Handoff, App Store and Apple Account are trademarks of Apple Inc. Apple does not sponsor or endorse the App.
- The App uses Apple services (such as the App Store and iCloud), Google Cast and RevenueCat (to check purchases). Their own terms and privacy policies apply to those services, and we are not responsible for their availability.
- The App includes open-source software, such as VLCKit. The licences listed on the App's Licences screen apply to those components and prevail over these Terms for them.
11. Privacy
The Melyro Privacy Policy, at https://melyro.app/privacy-en.html in your language and also linked in the App, explains what information the App handles, where it goes and how to delete it. If these Terms and the Privacy Policy conflict on how information is handled, the Privacy Policy prevails.
12. Changes to the App
- We may update, change or remove features of the App for valid reasons: to fix problems or security issues, to comply with the law, to keep up with Apple's systems and rules, or to respond to changes by providers or third-party services.
- Before we remove a paid Melyro Pro feature, we will give notice on melyro.app or in the App Store release notes. If a change has more than a minor negative effect on what you paid for and you are a consumer, you keep your right under your local law to end the contract and seek a remedy, which you do through Apple.
- We may stop offering, supporting or updating the App, or remove it from the App Store. A copy already installed on your device may keep working, but it may stop working with future system versions or sources. Where the law of your country gives you rights if a paid digital product stops working as promised, these Terms do not limit those rights.
13. Disclaimer of warranties
To the extent the law allows, the App is provided "as is" and "as available". We make no promise that any source, stream or format will play, that the App will be uninterrupted or error-free, or that it will work with a particular provider, server or device. We give no warranty about any content you access through the App. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Some countries and US states do not allow these exclusions. If you are a consumer, you keep the statutory rights you have under the law of where you live, including any legal guarantee that digital content conforms to the contract. Nothing in these Terms limits those rights.
14. Limitation of liability
- Limits. Unless Section 14.3 applies to you, and to the extent the law allows:
- we are not liable for content you access through the App, for providers' acts or omissions, or for your use of sources you had no right to use;
- we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, data or goodwill, arising from your use of, or inability to use, the App; and
- our total liability to you for all claims about the App is limited to the greater of the amount you paid for the App in the 12 months before the event that caused the claim, and USD 50 (or the equivalent in your currency).
- What we do not limit. Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- damage we cause on purpose or through gross negligence; or
- any other liability that the law of your country does not allow us to exclude or limit.
- Consumers in the EU, EEA, UK and Türkiye. If you are a consumer in these regions, Section 14.1 does not apply to you; instead, we are liable for foreseeable loss and damage caused by our breach of these Terms or our failure to use reasonable care, as your local law provides. We are not liable for loss that was not foreseeable, for loss of data caused by your failure to keep backups, or for loss caused by providers or other third-party services. Section 14.2 still applies.
15. Indemnity
If a third party, such as a rights holder, makes a claim against us arising from your intentional or negligent breach of Section 4, Section 8 or the law, for example by streaming or sharing content you have no right to use, you agree to cover our reasonable losses and costs from that claim. This does not apply to claims caused by our own fault. If you are a consumer in the EU, EEA, UK or Türkiye, this applies only as far as your local law makes you liable for that breach.
16. Ending these Terms
These Terms apply for as long as you use the App. You can stop at any time by deleting the App and cancelling any subscription. We may end your right to use the App if you seriously break these Terms or the Standard EULA, in particular Sections 4 and 8. This does not affect any statutory rights you have for a period you have paid for. Sections 3, 4, 9, 10, 13, 14, 15 and 17 to 21 continue to apply after these Terms end.
17. Governing law and disputes
- If you have a problem with the App, please contact us first at support@melyro.app.
- These Terms and any dispute about them are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules. Section 17 governs these Terms. The Standard EULA's own governing-law clause governs the Standard EULA.
- The Istanbul Central (Çağlayan) Courts and Enforcement Offices have jurisdiction over disputes about these Terms.
- If you are a consumer, the choice of Turkish law and Istanbul courts does not take away the protection of the mandatory laws of your country of residence. In particular:
- consumers in the EU, the EEA or the UK may rely on the mandatory consumer laws of their country and may bring proceedings in the courts of their country of residence;
- consumers in Türkiye may apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) or, where required, to mediation (arabuluculuk) before the consumer courts that Consumer Protection Law No. 6502 makes competent; and
- consumers elsewhere keep any rights that the law of their country does not allow a contract to remove.
- These Terms do not require arbitration and do not waive your right to a court or to join a collective action where the law gives you one.
18. California users
California users may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or by phone at (800) 952-5210.
19. Apple
Apple is not a party to these Terms and has no obligation to support or maintain the App. The Standard EULA sets out Apple's role.
20. General
- We may update these Terms for valid reasons, such as changes in the law, the App, Apple's rules or third-party services. We will post the new version at https://melyro.app/terms.html with a new effective date. For important changes, we will give notice on melyro.app or in the App Store release notes before they take effect, and in the App where possible. Changes do not apply to disputes that arose before them, and changes that harm you do not apply to a period you have already paid for. If you do not agree, you can cancel your subscription before the changes take effect and stop using the App. If you keep using the App after they take effect, the new Terms apply to that use.
- The Standard EULA and these Terms are the whole agreement between you and us about the App. The Privacy Policy explains how information is handled.
- If a court finds any part of these Terms invalid or unenforceable, that part will be changed only as much as needed to make it enforceable, and the rest stays in effect. If you are a consumer, an unenforceable term will not apply to you, and the rest stays in effect.
- If we do not enforce a part of these Terms straight away, we can still enforce it later.
- You may not transfer your rights under these Terms except as Apple's rules allow. We may transfer the App and these Terms to another provider, as long as your rights are not reduced.
- We are not responsible for delays or failures caused by events outside our reasonable control, such as changes made by providers, Apple, Google or network operators, outages or natural events.
- These Terms are written in English. If we provide a translation and it differs from the English version, the English version applies, unless the law of your country requires otherwise.
